Well, here’s thing, as I see it.

The more the SCOTUS majority deflect their duties to the states, the less they have to feel accountable for the obvious mismanagement of the law that has been apparent since Roberts took the big chair. Thomas and Alito aren’t the only ones who need to be gone. He makes the appellation Roberts Court a misnomer, every time he lets the conservative majority walk over him on their way to a “decision”.

Horrifyingly, it appears that no one is walking over roberts. In fact, HE is leading the parade to a full fascist dictatorship. He crafted the presidential immunity law and TOLD the other five to sign it. For real. I was beyond stunned to learn this recently.

Not this year, so very unlike 2022, when Thomas and other conservatives pushed through the Dobbs ruling and Roberts stood alone between embittered factions. The chief justice chided his colleagues on both sides for displaying “a relentless freedom from doubt on the legal issue.”

This year, he stepped to the right, and he displayed no doubt.”

He creeped me out 32 years ago. When he manipulated the white Democratic males in Congress by saying, "This is a high tech LYNCHING!!!" -- they all put their tails between their legs (and yes, Joe, you were the head of this Committee) and immediately voted the stinker in. By then, who gave a damn what Anita Hill had to say? And why listen to her witnesses, or to the other women whom he had sexually harassed and/or assaulted?

It was awful. I was shocked, too. He was (and surely is still) DISGUSTING. Sheer misogyny, and racism before they only approved clearance so no one would think that THEY were "racists".

Life is a little hectic right now, recovering from Helene. Trees are down everywhere. I didn’t have major damage to my house, but if my neighbor hadn’t cut down 6 big pine trees last year, I might not be here. This is worse than the ice storm 10 years ago, when Jim Cantore himself came to Augusta. I’ve been over a week without running water (I have children close by, thank God, who still have theirs). I’ll get by.

You know, when she cutdown all those trees, I used to say to myself, jokingly, “You’re not from around here, are you?” Both of our houses face south, in Georgia. I treasure my shade, and grieve the loss. She cut down her afternoon shade. Now, all I feel is unending gratitude.

I like that you're bringing this information to us, Tom. But I hate the information, Why, in hell, isn't the AMA speaking out and condemning interference in what is after all a purely medical procedure that belongs in the sphere of medicine NOT law.

Thank you MaryPat for this link. I am so very happy and relieved the AMA is speaking out against this disgusting and dangerous intrusion of ignorant legislators on the medical field. I realize that some doctors, for purely religious reasons refuse to perform abortions under any circumstance and that is certainly their prerogative. Even if they own a clinic they have the right to disallow abortions in their own clinic, against their religious belief. But they have no right to try to prevent other physicians from performing life saving procedures on that physician's patients. That's the whole problem with religious fanatics, they insist that every one, in or out, of their church MUST share their same beliefs, Maggots like trump and jd vance care NOTHING about the abortion or the baby. their sole reason is control over all persons of the female gender. If they kill a few women here and there, who cares? There are too many women anyway. Both have stated that women should happy and satisfied under the dominance of the male.

Clearly women are going to have to save women. Recruit fem drivers who will take women from red states to blue states for medical care. Use planes, trains and Uber automobiles. Come back with shopping bags. There's a woman in Italy, I think, who travels the coastline by boat providing off-shore contraception, morning-after pills, and mifopristone. The currently vastly successful cocaine retail network could add some things to their menu. Guess what! Women are still going to get abortions, just as they always have. And if they get caught and have to appear in court they can always claim that some guy named Ken Paxton, Samuel Alito, Clarence Thomas, et. al. is the father.

I'm guessing that there were not 4 justices voting to take up the appeal. In other words, 6 Justices of the Court declined to hear the appeal and chose to let the 5th District ruling stand.

The only consolation, if there is one, that perhaps some Texas women will finally realize that republicans do not see them as human beings and vote accordingly. If not, I find it hard to muster a lot of sympathy for them, and that hurts me to say it.

There is a solution no one wants to think about. Make the MOTHER who has a medically "unnecessary" abortion the one facing criminal charges, not the doctors. They could then go ahead and provide the care necessary to save the mother's life--and could testify as to WHY if anyone tried to prosecute the mother. I suspect most juries would believe the doctor--it would be hard to prove "beyond a reasonable doubt" that it WAS "unnecessary."

I'm not sure if Texas could impose a criminal penalty for an abortion obtained where it is legal and then returned to Texas. THAT would face more of a "states rights" argument amenable to the Extremes and most states who allow abortions are also resisting providing medical records.

Criminalizing the woman would be way more unpopular and might spur even more activism.

of course it is. The point is here, who would be “criminalized?” Certainly not any of the cases we’ve been reading about where the doctor has been too scared of jail to take proper care. Even assuming a prosecutor was fool enough to try to go after such a woman, the outrage would be heightened far further than it is now.

Red states are already criminalizing women who act without doctors. In Louisiana, just HAVING an abortion pill, not even taking it, can send you to prison. Women are being accused of murder because their miscarriage was caused by an “unhealthy lifestyle.” At least if the statutes were consistent about who was “to blame” those needing help could get it without the doctor fearing giving it.

It is easy to say “something must be done to stop this.” The problem is how to GET that something done. If I have to choose between outrages, to get people’s attention, I’d choose criminalizing a mother over letting her die, anytime.

But mothers are “safe from jail” if not a coffin because the legislators KNOW that criminalizing the woman is a bridge too far. They just pass the deaths off as “God’s Will.”
