King George is looking down saying, "I told you it wouldn't last. You had a monarchy. You could have saved yourself a revolution and had the monarchy you are now getting."
I was waiting to hear from you regarding the appeal in the 11th circuit. I am happy to hear you say that this will "almost certainly" happen. I think I had also read earlier about the possibility that Cannon will be thrown out of this case if the 11th circuit ruled against her due to a "three strikes and you are out" situation. Does anyone know about this or am I just hallucinating? :(
Absolutely. It does smell of the kind of dramatic gesture the GOP under showman 45 excels at, doesn't it? I suspect 45 and his legal team were let in on the decision and told to hold it until the opening of the RNC and that it's the "big news" 45 was teasing, not the VP pick which has been separately teased and which they have said may not even happen quite yet.
By now I expect you know the VP choice has been announced - another vomit producing selection: J.D. Vance. Can you imagine a President Vance if tfg drops dead or is removed under the 25th Amendment? OMG!!!!
Knowing how quickly the special counsel’s office has turned around appeals, I’ll wager this is before the 11th Circuit within the next 5 days. Assuming they win, Smith’s team must absolutely request a different judge. Judge FanGirl has proven herself unqualified to sit on the federal bench and absolutely unqualified to preside over cases involving the ex-president.
I wouldn't be surprised if the Special Counsel has had his basic appeal submission ready to go for days if not weeks, probably immediately after the filing by tfg's defense attorneys if not before.
Yeah, she is queuing this up for the supreme court to rule that special counsels are unlawful. The appeals court will almost certainly overturn this, but trump's lawyers will appeal to the corrupt SC so that they can overthrow this part of democracy too. And it also means more delay, which was another goal.
Yes, we knew this was coming, but it still turns my stomach. If the worst happens in November, Aileen Cannon will go down in history as one of the dismantlers of American democracy.
Just hit me. Under Cannon's ruling wasn't the investigation of Hunter Biden and that of Biden by Hur also unconstitutional?
I can't see why DOJ just can't assign a normal prosecutor in place of Smith. Ah, but if "fruit of the poisonous tree" precludes the use of the evidence--then Hunter's conviction must be reversed AND the upcoming tax case dismissed.
IIRC the special prosecutor was appointed to remove the prosecution from the direct supervision of DOJ, which is part of a Democratic administration. Since the #1 defendant is a, shall we say, high-profile Republican, this seemed like a wise move.
The conduct of this trial has been a major embarrassment to the 11th Circuit. Judge Cannon has so obviously been in the bag for Trump it is obvious to grade-schoolers. She will almost certainly be replaced if the decision is overturned, though Trump will certainly appeal on his own. With the SCOTUS we have now, it is entirely possible her dismissal will be upheld. In that case, the DOJ can say, the hell with special prosecutors, we're going to try the SOB ourselves..... If Trump loses in November, all these cases will magically move to a fast track, because there won't be any reason to delay them since he won't be president. He is still going down for what he's done, if we do our jobs Nov. 5th.....
We ARE going to do our jobs November 5th. From the feedback I am receiving from friends, the event on Saturday has only increased their fervor. I won't write here nor will I post on FB what has been said privately and what is being said WIDELY about that "attempt." But, you probably can read between my lines.
Thank you, Tom . I've been expecting something like this from Cannon. That woman does not belong in any court of law, at least not in the United States. I hope Merrick Garland acts swiftly and appeals to the 11 circuit court. I'm sure they will find against Cannon. Here is the important part of the clause on Appointments to which she referred: Article 2, Section 2:......"but the Congress may by law vest the appointment of such inferior officers, as they think proper, in the President alone, in the courts of law, or in the heads of departments." This is what dumdum Clarence Thomas referred to in his concurrence July 1st.
Special Counsel was first appointed by President U.S. Grant in 1876. Since then there have been Special Counsel's appointed by the DOJ, most notably during Watergate, and the Cllinton Preidency and of Course Robert Mueller v trump and the idiot who went after Hunter Biden in an attempt to smear his father Joe Biden. So there is no reason to call wrong doing in the case of Jack Smith.
Perhaps, given the 11th Circuit's history vis a vis Judge Cannon, she saw this as her chance to get out of the morass with at least a modicum of self-respect. She will almost certainly be reversed on appeal, even in light of the recent illogical Supreme Court finding on immunity and Smith is too good a prosecutor not to take advantage of the chance to get a new judge on the case. It might even (and I promise I'm not smoking anything, legal or otherwise) provide an opportunity to get a conviction back to the Court after the failed insurrectionist loses in November so that they can reestablish contact with both reality and legal logic. Hope springs eternal.
Your surmise about why Cannon made such a ruling crossed my mind as well. However, it does require 4 Justices to decide to take up a case and there are 5 possibilities on the Court (not counting Roberts). We mustn't forget that we had 'surmised' that the Court wouldn't take up tfg's immunity claim...
I assume nothing in the judicial morass we occupy currently. The only ones who made asses of themselves were the 6 Justices who concocted the decision.
How... very restrained of you. When I saw the news this morning I thought I'd be able to spot the email with your commentary just by zeroing in on where the smoke was trailing up from the inbox list.
I suspect this is what 45 meant when he said there would be something big announced this weekend. If so, that means Cannon shared this with the Trump legal team a few days in advance. That would sound like collusion to me. I will be watching with interest to see if there is any other possible candidate for the "big event" announcement this weekend, other than announcement of the VP choice, of course. Something about the wording did not make it seem like that was going to be it.
So, it gets appealed. The circuit court overturns it and perhaps (we hope Finally) assigns the case to a new judge. That gets appealed. It goes to the SCOTUS. Now that with the immunity decision they have broken the glass and seized the fire suppressant and sprayed the fire fighters do we have any hope they will put out the fire that's burning up all laws and justice in this country?
I'm all in for Biden, but I am very fearful he is too much of a traditionalist to expand the SCOTUS and we cannot wait five or ten more years with this bench waiting for at least two of them to retire (they won't) or pass away from old age or illness. He needs to realize it's his last opportunity (if we give it to him) for the history altering big move.
Merchan and Engoran have been pilloried and threatened by the wingers, but Cannon will be beatified. All are more symptoms of the moral and intellectual rot that's set in, and it's getting tougher and tougher to counter. But trudge on we must. We just must.
Yup, "we knew it was coming" as Justice Thomas signaled his approved route in dicta in his "immunity" concurrence.
As much as I would like to see the 11th Circuit public spank Loose Cannon for a 3rd time, just have the local Florida U.S. Attorney's Office refile the same allegations within a week or so.
If that happens -- I know who I would hire if I was the local US Attorney's office Chief; his name is JACK SMITH.
Excuse me while I scream into a pillow…..again. The rule of law is under assault by the very people assigned to uphold it.
King George is looking down saying, "I told you it wouldn't last. You had a monarchy. You could have saved yourself a revolution and had the monarchy you are now getting."

That's likely.
Yes, this is terrible news, but this is the decision Smith has been waiting for, to take this legal bimbo to the 11th Circuit and get her tossed.
That's Judge Bimbo.
The timing of this decision is certainly interesting.
Absolutely. It does smell of the kind of dramatic gesture the GOP under showman 45 excels at, doesn't it? He can imagine it. So can the puppeteers
very likely.
Let's hope so, and let's hope he's successful.
Thanks for (hopefully) good news! Of course, the goal is delay, delay, delay..
From your intelligent question to my heart, Geeta. I hope you and Tom are correct. And thank you thank you.
I sure hope that gets overturned, yet another example of our newly crowned king!

Not merely unqualified, but UNFIT to be a judge.
I wouldn't be surprised if the Special Counsel has had his basic appeal submission ready to go for days if not weeks, probably immediately after the filing by tfg's defense attorneys if not before.
Yea. And if not, I’m sure Thomas’s concurrence regarding special counsels spurred him into action.
Yeah, she is queuing this up for the supreme court to rule that special counsels are unlawful. I was awakened by a weeping friend a few minutes ago after a night of the usual insomnia.
obviously, this is outrageous and crazy. and hardly surprising.
I think it'll be reversed on appeal. but I'm very, very angry.
and TFF's promise to pivot and call for "unity?" I think we know what kind of unity. it will be amusing to see what he comes up with.
I'm going back to bed.
If he thinks I am going to unify with his arse, he’s been eating his own Schitt.
Just hit me. Under Cannon's ruling wasn't the investigation of Hunter Biden and that of Biden by Hur also unconstitutional?

Of course. It follows the idea of “being fair.” But Cannon apparently took an oath that said “being fair is against my principles.”
She seems to have taken a similar oath against being competent.
We should start calling her a DEI hire
nice. and she doubtless WAS.
She needs disbarring, and her law school alma mater needs to look at revoking her degree.
Sounds right to me.

a bunch of us have said it here already. I haven't spoken to anyone who doesn't think it was fake.
Someone I know texted me a profile image of tfg with a take-out packet of ketchup behind the right ear.
Roger Stone and Steve Bannon, my guess but so many clever genuses just love to create chaos.
From your keyboard, Bruce, to God's eyes.

Add in the Special Counsels appointed to look into classified materials retained by Pence and Biden.
You're right Judith, and there wasn't a whimper about those!

well, I've been smoking plenty but you DO sound a lot higher than I can manage to get.
and I'm APPLYING myself.
but yes, at some point today, I just might find myself sharing your optimism. who knows?
Wishing there was an LMAO emoji on Substack David. Also wishing you the best of luck in your endeavor.
on the way, on the way...

Don’t assume that she will be reversed. We all assumed that with the immunity crap and made asses of ourselves

As a quick reference, I've gathered the statutes and cases in my own substack, along with some snide comments.

Jack Smith was a prosecutor
for DOJ before ICC.
Wondering if he would still
hold that title, even if working
with/through another court?
Thanks for you Substack link.
I don't think Cannon or
Trump's attorneys can get
away with this. BUT, Clarence
Thomas oversees the 11th
Circuit and Cannon.
Oh, lordy
