I can't see why DOJ just can't assign a normal prosecutor in place of Smith. Ah, but if "fruit of the poisonous tree" precludes the use of the evidence--then Hunter's conviction must be reversed AND the upcoming tax case dismissed.

IIRC the special prosecutor was appointed to remove the prosecution from the direct supervision of DOJ, which is part of a Democratic administration. Since the #1 defendant is a, shall we say, high-profile Republican, this seemed like a wise move.
