The decision didn't define what was outside official acts (core and peripheral), and it's going to be hard for Trump to argue that his conspiring, insurrection, fake elector schemes, and calling Georgia, are official acts, rather than personal / private. To my mind he's not off the hook at all - but he has bought more time, yet again.

Hopefully Judge Chutkan will say "Thank you SCOTUS, but Trump isn't on trial in my court for any core official acts, because core official acts aren't crimes. So on with the show."

I'm not actually sure how else they could have ruled. Lots of officials (both elected and appointed) in a wide range of countries are given immunity from being sued or charged for decisions and actions that are part of the job - even if they do them badly, and/or third parties are adversely affected.

Now if Trump successfully argues that ALL his actions to try and hang on to the presidency were official acts, including incitement to riot, creating fake electors, and leaning on Georgia, then you really do have a problem. But until that happens I don't think the dude has had a huge win.

Same with the classified documents case ... Trump has broken clear laws in relation to documents, and taking them to Mar-a-Lago cannot be an "official act" just because a former president thought it was, or wanted to do it, or something. Basically an official act can't break a federal law - or even a state one - it would seem to me.

Since you don't mention being a lawyer, you may want to reconsider that decision not to take that remedial class in reading comprehension. The vote counting points are seemingly outside of "official acts." As to the rest, everything in the Constitution regarding the Article II powers refutes what "other countries may do," most of them not being democracies.

Here's the truth as I see it: There is ONE QUESTION on the ballot in 2024. Do you the voter choose Democracy or as Robert Kagan labels it Anti-democracy? Everything else will unfold from THIS vote. EVERYTHING. A vote for ANY gop candidate from the top of the ballot to the bottom is a vote for anti-democracy and the foreclosure on all the hopes and dreams you may still hold for yourself, your family, community, future generations. I am not fearful for the future. Rather, I am determined there will be a future for YOU and all others and this planet. The so-called "scotus" has been preparing the ground for minority governance shaped by Fascist ideology. It did not begin yesterday. Why else would a raft of right wing organizations have been founded during the first reagan administration? The democratic party is far from perfect but their candidates are supporters and defenders of democracy and therefore defenders of our nation as free and independent. Hard work is needed now. Not panic. As Jen Rubin has said so well, "GET A GRIP"! We have a President and an administration doing really good work for ALL Americans. Can they do better? Yes! But they need majorities in the House AND the Senate. And WE need President Biden and VP Harris in the White House. Project 2025 must be torn up. Let's begin by being clear that our votes must be for democracy first.

Does the decision say or imply this? The Court was asked to decide whether a (former) president has immunity from charges when performing official acts. I'm not sure how else the could have ruled on that. Do you want the children of Osama bin Laden to come after Obama for knocking off their dad?

But they haven't determined that the insurrection or fake elector scheme were official acts - it was returned to the district court.

There could be two upsides:

(1) Judge Chutkan can being more-or-less straight away to being to test all the evidence, put all witnesses on the stand under oath - all before the election;

(2) It might steel more voters to vote Democrat - voting against this utterly rogue Supreme Court, and the threat of an immune corrupt President Trump going feral in a lame-duck term.

Fortunately, Tom. Judge Chutkin is NOT brain dead Judge loose Cannon. She 'might' throw out ONE indictment - that he tried to appoint Jeff Clark to save his sorry ass. Presidents are allowed to appoint - with the advice and consent of the Senate anyone they damned well please. But pressuring your Vice President to throw out officially signed (by the State Governors) legal ballots has NEVER been an official duty of any President. Until the trumpster, every single President (except those who died in office) has graciously welcomed their incoming replacement. Nothing else with which he is charged comes within 10 miles of an official duty.

Judge Tanya Chutkin read those indictments last year when she first received them. She might re-review a few,but he is a reasonable judge, she won't drag her feet and if at all possible she will clear her calendar to get the trial started. There's no place else for baby dumbo the trumpster to appeal - tough patooties - you are toast.
