Senator Whitehouse is the sponsor of SB 359, https://www.congress.gov/bill/118th-congress/senate-bill/359, the Supreme Court Ethics, Recusal, and Transparency Act. Jess Craven has scripts to call your senators. ⬇️

Call Dick Durbin and tell him it’s not enough for Justice Alito to recuse from cases involving Trump. The Senate Judiciary Committee must start an investigation into a possible impeachment.

The Senate Judiciary Committee cannot start impeachment investigations. by the Constitution, only the House of Representatives ca investigate and write articles of impeachment. The House then debates and decides whether not to impeach. The Senate then holds the trial, guilty or not guilty. In 248 years 3 Presidents have been impeached. Andrew Johnson, once, Bill Clinton, once, and Donald Trump, twice. NO President has ever been found guilty. 15 Federal Judges have been impeached 8 found guilty.

The only punishment for guilty is removal from office.

Agree, Fay. In the link above to Jess Craven’s /Chop Wood, Carry Water there was also a script for calling House Reps.

I’m one who believes every action matters. It literally takes me under a minute to call my legislators and have my voice “heard”.

I’ve read your posts with sincere appreciation. I hope to have your determination as I progress on my life journey…

Like Trump, these people commit offenses so fast that it's hard to keep up.You start screaming from the rooftop About one thing they've done and they do five more before you get the words out. The worst thing about it for me is that i'm disabled and it'll be damn hard or impossible for me to just up and leave the country. I really didn't think this would happen while I was still on the planet. Then came Trump, and the scum came out from under the rocks.

Yep. Jess is great. Time to put all of those on speed dial.

I didn't keep a copy so I can't reproduce it here, but I just emailed Senator Padilla and expressed outrage and demanded that he call for hearings, demand that Alito recuse himself from the presidential immunity case, demand that Roberts rein in his out-of-control justices, and call for court expansion. This corrupt court is doing everything they can to get Trump re-elected, which is what the billionaire plutocrats and Leonard Leo, who bought and paid for this court, want to happen.

Padilla is, and had been throughout his public career, useless

I've been increasingly impressed by Representative Sara Jacobs from San Diego and would support her candidacy when Sen. Padilla is up for reelection. I'd be interested in your take on her, Gary.

Sara’s positions line up pretty well with most of the friendly people who post here on TC’s page. She also has been critical of Israel’s incursion in Gaza notwithstanding her Jewish heritage. She is the granddaughter of Joan and Irwin Jacobs of Qualcomm fame (with whom I’ve worked on philanthropic endeavors—Joan passed a couple weeks ago), and so her campaigns had been funded by her grandparents to date. Her grandparents have been good people and not self-important rich types but I can’t be counted as a disinterested observer. Her early campaigns were marred by missteps which I attribute to the consultants she was using; I hope, but do not know for certain, that she has dumped them. The one area where I do not know Sara’s positions well (or that of other members of her family), is in the area of labor relations. Don’t know if she’s pro-union, which is an issue important to me but not commonly appreciated among the well to do. However, based on what I know to date she would be an improvement over Padilla. I will caution that the Democratic Party here in California is becoming a bit musty and self-satisfied and so the party will circle the wagons around Padilla. Sara may not attempt to unseat an incumbent.

Thank you, Tom, for so succinctly expressing my response. A small typo on your part has given me a good laugh: "rule of low" I knew you meant law in the context written, but the rule of low is so much more effective for the MAGA cult. Your remark on "how broken the system is" only applies to those of us, who like you, believe in a democratically based representative republic. If you look at it from the maggot point of view - it isn't broken, since the Lowell memo of the 1970's they have been working slowly, but diligently, to create exactly the fascist dictatorship they always wanted. At the same time 'dis-educating' a sufficiently large enough portion of the public to willingly accept their demise. The trumpster has proven to be a boon to their plans: the perfect puppet. Who could ask for anything more? In the trumpster they have a truly stupid man, who's clownish antics can enthrall their semi-literate base to the point of accepting any degree of degradation.

As for your disgust with the Democratic Party and politicians; I understand. I live in Sacramento County County and have always been proud of our liberal progressive stance. I immediately emailed my Congressman (6th District) Alex Padilla, and President Biden. You're right, Biden can't "fix" this alone. I asked Dr. Bera to draw up articles of impeachment against at least five of the current Supreme Court on specific charges of violating the Constitution. I asked Senator Padilla to support impeachment. I told them I was aware nothing could happen this year, but we should at least let the public know we intend to follow the law next year. So, far I've only received their boiler plate - we've received your email - responses.

As to the "unethical" retrumplicans dutifully marching to New York to break the gag order for dear leader, we should also note: They are doing this at our expense. WE, in the liberal progressive States pay far more of the Federal Tax dollars to pay for these unauthorized trips to New York. But I haven't heard a whisper of this fact from mainstream media. Not only do we pay their unearned salary of $274,000 per year - we also pay their expenses, health care, and all other benefits. I have no doubt in my mind they even stuck us with the airfare. Paying them to bloviate in Congress is one thing, paying them to rally round the trumpster is something vile.

Fay, I'm sure you meant the [Lewis] Powell memo (1971). Here's a refresher for those unfamiliar with it. https://scholarlycommons.law.wlu.edu/powellmemo/

Thanks Judith. Yes it was the Lewis Powell memo to the Chamber of Commerce. [I was too lazy to look it up at the time (:-)

The current court reform proposals are actually mild. A thorough remedy would be for Congress to create a new Federal Review Court with all the guardrails and assign it jurisdiction over all matters not specifically delegated to Supreme Court original jurisdiction in the Constitution.

Expand full comment

A better remedy would be to have a group of Citizens write up what we think a code of Ethics, should be for ALL appointed, elected, or employed Government Workers. As of now 8 Federal judges were removed from office after impeachment, but thousands of Government employees have been fired for breaking a code of ethics.

There was a time when SCOTUS nominees were well vetted before being nominated, and it didn't take confirmation hearings to expose those credibly accused of graft, corruption, and sexual misconduct.

We are doomed by our own shoddy indifference. Too many Americans are utterly clueless and couldn't be more proud of it, and their votes will cancel out yours and mine. I'll be calling Durbin.

There is still too much reflexive respect paid to the Supreme Court. There is a fear among Democratic officialdom that taking on the justices will lead to erosion of the rule of law. But of course, doing nothing will error the rule of law. Well, if you’re damned if you do, and damned if you don’t, you might as well do what your personal sense of honor demands of you and let the chips fall where they may.

TC (Tom)—you said

“Ginni Thomas - wife of the other MAGA justice on the court - is on the record in her own words that the supporters of the insurrection were only stopped from likely obtaining an order from Alito to stop the vote count on Jnuary 6 by Speaker Pelosi moving to quickly reconvene the House after the treasonous white trash scum were removed from the capitol and finish the process of approving Biden’s election.”

With utmost appreciation for your justified outrage, I hope you’ll check to be sure Ginni Thomas is really on record saying this. I heard Sydney Powell express this exact sentiment in an interview with some right wing interviewer. If I can find the link, I’ll provide it.

I too called my congressional delegation to demand hearings into Alito's misconduct -- which is like spitting on a fish since I live in Idaho, but at least some staffer has to log my comments. The guy who answered the phone in Simpson's (congressman) office actually gave me some pushback on court reform and also said we shouldn't assume bad things about someone because of what their spouse does. I am not making this up.

With regard to authoritarians and, especially, tRump: when will his mentally-diminished followers, especially those who are sniffing at his ass to become VP, realize that they are all useful idiots to the "Dear Leader".
