As a regular contributor to The Southern Poverty Law Center (SPLC), I am requesting they add The Federalist Society to their list of extremist groups.

Practical illumination and summation of current situation, TC. I favor the route that the DOJ can take on appealing the standing of the decision. Anything to quickly get a brief out clearly outlining the threat that the current situation presents. And to smack down La Cannon in the process. She sees herself right on the path to a another MAGAts SCOTUS nomination. Pfffft. What incompetence. Currently Florida is a state and local judicial pit of injustice and partisanship.

Thank you, TC, for all your reporting this week.

TC,

How do citizen's correspond with Judges? How do we let them know what we think of political considerations and favors vs upholding the rule of law? I can google search a judge but dont see their office phone or email? Why is that?

Because we mere mortals who pay their salaries don't get to do that. We might influence their decisions in "improper" (according to their benefactors) ways.

...but it is okay and perfectly legal for the Federalist Society to groom conservative leaning law students from their law schools to prepare them for a career of service to Oligarchical handlers and benefactors with social ladder benefits, promises of paid vacations in exchange for speaking fees, additional speaking fees, and paying off their debts and mortgages. Who paid all Bret Kavanaugh's debts btw? Does anyone know?

Is there a petition to impeach Justice Thomas yet? Oh yeah....there is, and lets all send a message to all Federalist Society Judges by signing it.

So given that she is rated as unqualified and has made this egregiously bad judgment, how can Judge Loose Cannon be removed? Is there an federal equivalent of traffic court?

Expand full comment

She would have to be impeached.

Is incompetence grounds for impeachment?

Good question Jenn. I'll leave it to one of the lawyers in the group to answer.

Look up the address of the southern district of FL court.

I think I understand the basics of an issue. And wonder what more can be said. Then I read your posts and see that there's much more. Thank you.

Thanks TC, you've done a great job of wrapping up a few different sources that many of us seem to be following now, and I found this article helpful in putting to rest some of my thinking on the abundance of information today (9:30 pm here).

I'm quite stunned by the revelation of the potential repercussions that “The Loose Cannon Rule" has set for every criminal case involving physical evidence. Also hoping that the consequences of this judge acting beyond the bounds of her constitutional remit are swift and severe. Probably not but, as her seniors and betters have said, it is inconceivable that such an upstart should breach the separation of powers in this way.

Regarding the "leak" about "nuclear capabilities of a foreign ally," well maybe I'm just getting more suspicious-minded with age but something smells funny to me. The timing is good for the typical red herring dragged across the trail distraction we've seen used before. Get the medias and everyone talking about some other "shiny" thing than what Sleepy Joe and the wokes want. The side effects of it causing concern among America's allies, and damage to international relations, well that's just added bonus. How many diplomats have already quietly asked "Is it us?" The leak could even be a lie, would that be such a surprise? The tip wasn't sent from a burner phone in Little Moscow was it?

I rather suspect the leak of the information on finding the nuclear material came from someone who wanted to illuminate the problem - it's not a "shiny object" that helps Trump in the least; in fact quite the opposite.

I was thinking of an external force, perhaps a frustrated purchaser of purloined material turning on the seller they previously backed but now think is of little or no further use to them.

Good analysis, TC. Judge shopping and stacking the courts in the Jurisdiction that tfg resides will long play out for Trump, Inc. Hadn't thought about checking fingerprints, but wonder about other Trump properties and what they might hold, especially from the empty boxes or boxes missing documents so assigned to them.

And Ivana’s casket which took 10 people to carry, so I saw someplace!

Yes, I've been wondering about that, too, Chris.

Must the government appeal in the 11th Circuit, or might it appeal in DC if it wishes to also appeal the issue of standing?

Not a lawyer here, but as I understand it, you have to appeal where the problem happened.

There's a case to be made for bringing an action in the proper court of adjudication regarding the Presidential Records Act, however.

Expand full comment

Me either, but I think DOJ can petition for removal to DC.

Thanks for bringing to light the details around the special master decision, and the positivity of a DOJ appeal. I hope the situation unfolds as you’ve suggested.

Expand full comment

As it stands, the investigation is over. Trump will contest any special master he does not name and the court will honor that request.

Expand full comment

That's what's expected by Trump's side, but not necessarily what will happen.

Expand full comment

Unless they alter the experiment - contest the decision in a DC court, where it actually belongs - maintaining the pretense that 11th Circuit courts are operating on the level will be fatal to the investiagtion because there will never be a special master. That requirement is a formula for endless litigation.

Yes - which is why I think there will be some "major moves" by DOJ.

The appointment process begins with a list agreed to by both sides in the case so there is no basis for disagreement. The challenge, as TC notes, is finding a qualified attorney who is TS/SCI cleared.

And the delay if they do not agree.

Judge Cannon gave them a deadline, either today or tomorrow to submit the list.
