Thankyou TC. If you havee time, watchYoutube of Sen. Sheldon Whitehouse at the Nomination Hearing for Amy Coney Barrett, " Something is wrong with this Court." He laid out a case to show how dark money is controlling the decisions as to who gets nominated to SC and actual Court actions. Corrupt Court indeed. The Senator challenged her to go into her SC role with this knowledge, to be aware of the real situation.

I saw that in the original hearing. And of course she (and any other Federalist Society "project") knows.

Thanks TC for your cogent (and passionate) analysis of where we find ourselves now. You are, I believe, correct that we need institutional-level changes to overcome the current imbalances in the system--and unfortunately correct that the political forces (and will) to do are sorely lacking. There are many things to be mulled over in our long history of deifying the Constitution, and the more recently ascendant "schools" of constitutional construal. For the time being I would add that it is eye-opening (if you still need that) to read the dark docket ruling and to contrast them to the reasoning of the dissents. It's only 12 pages total--though like Allen you might want to schedule your reading around bathroom trips.

Oh yeah. The 5 Injustices wrote incoherent crap. Even Roberts complete dissected them.

An apt title and noteworthy posting!

And so, we peons are helplessly subjected to "what will be, will be." Not much comfort.

As with everything else, it's "Buckle down, Winsocki, buckle down! You can win, Winsocki, if you only buckle down!" Get a 55 majority in the Senate next year (possible, with the 5 R Senators who are retiring, with the likelihood that their R replacements will be uber-Trumpers who can win a primary but turn off normal people in the general), with that new 5 being people who are pro-choice and anti-filibuster, the game could change in 2023. Nothing good was ever won without a fight.

May it be so.

Hell of a thing to read at 2 am. That will teach me to check my email after going to the bathroom. You are right of course. However your Senate has stood in the way of progress for a generation or more.

Longer than that. Like, since 1789.

Excellent piece today, TC. It brings several things to mind. 1) “The law is but man’s opinion.” A true and scary thought and not original to me, but I can’t remember where I read 44+ years ago. 2)Filibuster = sabotage. Look how the filibuster has been used historically, and it is only a procedural rule of the Senate. Unconscionable! 3)What good are laws when those tasked with executing them say, “So what,” and shrug their shoulders nonchalantly. Example-Susan “He learned his lesson” Collins.

Hi TC— I totally agree that at this point Breyer should resign. Apparently he’s considering it. I knew Amy would be trouble for abortion rights. Btw I checked out your photo for the first time and you don’t look anything the way I pictured you on Heather’s newsletter. You’re much more ruggedly handsome.

Hey, TC. Term limits for SCOTUS is my thought. Have to agree with you about RBG, particularly as we are facing the same fate with regard to Beyer.

Liz is absolutely on point...you are much more ruggedly handsome...swoon!...but do have my own ruggedly handsome hubby, so no stalking here!
