I do believe Joe Biden, being immune, needs to issue an executive order requiring the arrest of the people challenging this. Look up Lincoln and habeas corpus.

Biden would be immune from prosecution to order all six of the power grab corrupt court killed, but he won't because he is a decent man who believes in the rule of law even for horrible people who don't.

I agree. And that's the problem with us Democrats. Sigh.

One of the problems…

Actually, it may well be THE problem. It's why I welcome Rick Wilson, despite his lack of sackcloth and ashes, because he understands how Michelle Obama should have said it: When they go low, we get a rusty, unsharpened knife and perform an unanesthetized castration.

Love this. Both Obama’s were trying to prove that they were not uncivilized heathens. Quite a challenge since the election brought out all the rusty knives that Repubs had been hiding. Who knew that our “great leap forward” just exposed the demons that had been wearing masks. I should have known the week after the election that it would turn more ugly than any expected. My BFF’s son started screaming at me that Obama was a socialist who would destroy capitalism. He was an idiot so I just blew it off. Silly me

I have a former student who moved to North Carolina in 2007 and told me that at what we might call events that didn't attract the least common denominator--Rotary Club, etc.--the n word was commonly used to describe Obama. And I wasn't surprised, because I will guarantee that the overwhelming majority of the republicans in Congress, as well as their nominees, have used the word regularly.

Couldn’t he just put Aledo and Thomas in jail?

Alito, not Aledo

Joe won't abuse the dubious SCOTUS ruling on immunity. It would violate his ethics.

Biden is a man of decency and integrity. As evidenced by his stepping down as a candidate for the good of the country.

Someone of Joe’s character rarely rises to the presidency.

I clicked 'like' Tom, but I really hate it. We absolutely MUST have a trifecta this fall. Alexandria Ocasio-Cortez has already filed the impeachment papers against Alito and Thomas. With a Democratically controlled House of Representatives and Senate we could be rid of the two worst apples on the Supreme Court. With the addition of 2 REAL Constitutional and law abiding Justices (not necessarily Democrat - just experienced judges who have over long periods of time consistently found on the side of LAW not belief. Then all Americans, regardless of gender, religion - or lack thereof, skin color, preferred language, Country of origin, whom they love - everyone that is except physically dangerous criminals - would have equal rights under the law. We may not all be born equal, but we sure as hell deserve the same right to equality under the law, ability to earn not just a living but a livelihood. Billionaires are not intrinsically "better" than other people - frankly I consider Elon Musk to be the scum of the earth.

Thanks for posting this ,TC. The Liberty Counsel is based in Orlando,Fl. Take a gander at just one gem in their doctrinal statement.

As you all know, this will not be popular with the majority. Please, keep shouting the word out about Project 2025. It’s happening NOW …especially in Florida.

It's all about control, across the board control with them being the controllers so they can "have their ways" with the controlled. It's a primitve Alpha thing writ large.

So, if I get this right, I am an affront to their practice of religion. I must be forbidden from all of the protections and advantages of marriage because their flavor of religion says in must be so. Why is my religion less important than theirs? What about my religious rights?

Expand full comment

Exactly.

Expand full comment

They have a malignant need to feel superior. The only way they know how to do that is by creating inferiors. Then, everything of theirs is more important than yours and mine. Equality can only diminish their superiority.

RE: "...the legal fiction of substantive due process..."

Genuine due process of any kind will eventually become a complete fiction if these now-out-of-the-closet fascists get their way. Vote not just "friends and family" but freedom and liberty. And fuck the fascists and Trump and his so-called hillbilly that they're trying to ride in on.

And until lawyers are regularly and effectively sanctioned for bringing frivolous and dilatory actions it will never end. There is no basis in law for most of the B.S. that courts at all levels are confronted with and even less for the idea that a district judge in one part of the country can issue a decision governing behavior throughout the country. One of many reforms we need to see started in the next 4 years.

Did they file a notice of appeal back in 2022 when the original judgment was entered? If not, I'm not sure they can appeal the judgment itself. They can argue attorney fees because there was obviously not a contract providing for them. But that is a different issue from the appealing the judgment itself.

When we say the rule of law, what do we even mean anymore if the law can be changed with the power winds of politics? This SCOTUS has turned established precedent into a gelatinous mess inside a bowl of the church law of a single religion.
