It’s no longer the Supreme Court. It’s the Unsupreme Trump Court, and the six fascist traitors who are Injustices rather than Justices no longer care what the public thinks of what they do. And what they’ll do is whatever it takes to insure that Dear Leader - who placed three of the six where they are - is allowed every advantage in his fight to avoid becoming a federally-convicted felon so that he can be The Man Who Destroyed The Constitution the six traitors took an oath to protect.
In a nutshell, the court ruled this morning that Virginia can cancel more than 1,600 voter registrations the state claims are held by noncitizens in advance of next week’s election, regardless of any rules or traditions regarding the responsibility of the courts not to fuck with elections within 90 days pof their occurrence.
The court’s three liberals – Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson, publicly dissented.
In August, Virginia Governor Youngkin signed an executive order that all individuals who were found in a records match of voter registrations and Department of Motor Vehicles records not to have attested they were citizens on were to be removed from the voter list on grounds they were noncitizens.
While research indicates such a situation is a rare occurrence, Republicans have drawn attention to noncitizen voting in a series of lawsuits this election cycle. Virginia was backed at the high court by all 26 Republican state attorneys general, the Republican National Committee and multiple conservative groups.
Democrats view the strategy as aimed at sowing doubt on the legitimacy of the election to lay the groundwork for ultimately contesting the results.
The Biden administration sued Virginia election officials over the 1,600 people removed from the state’s voter rolls as result of Youngkin’s order. The Justice Department contended the cancellations violated the 90-day “quiet period” when states are prevented from enacting systematic voter purges in the lead-up to an election that is mandated under the federal National Voter Registration Act (NVRA).
A group of private organizations that joined the Biden administration - the Virginia Coalition for Immigrant Rights, League of Women Voters of Virginia and African Communities Together - quickly identified citizens among the list. “Notably, applicants have provided no reason to believe that any noncitizens have voted in past Virginia elections, or that any are likely to do so in the upcoming election,” the Justice Department wrote in court filings.
The Biden administration and the private plaintiffs were backed by 17 former Republican members of Congress, all of whom have left the party and endorsed Vice President Harris.
The federal district court judge hearing the case found that some of those removed were eligible voters and that Virginia officials hadn’t shown the others “were, in fact, noncitizens,” and that Virginia’s action did violate the NVRA rule about the “quiet period.” The decision was affirmed by the Washington D.C. Appeals Court.
Virginia made an emergency appeal to the Trump Court arguing that the quiet period doesn’t apply to noncitizens. The Virginia Attorney General’s office wrote that, “States are free to systematically remove noncitizens, as well as minors and fictitious persons, at any time, including within 90 days of an election, without running afoul of the NVRA.”
Virginia officials contended the court-ordered reinstatement was improper under a legal doctrine known as the Purcell Principle, which states that courts shouldn’t intervene too close to an election to change voting rules. (No mention being made about state action to change voting rules that is done too close to an election.)
And this morning, the six Injustices of the Trump Court demonstrated that legislative rules be damned, along with previous court decisions. Stare Decisis? Stare Decisis? We don’t need no stinking Stare Decisis, stinking lib’ruls (with apologies to John Huston and The Treasure of the Sierra Madre).
What matters to them is that Our Side Wins And Fuck You.

This is why, once we overcome all fascist efforts to take power by assaulting the right to vote and have your vote count, item one on the coalition Congressional to-do list must be fixing the court.
Personally, I favor restricting the corrupted court's jurisdiction to constitutionally defined cases of original jurisdiction, which are a tiny percentage of current cases. Create an entirely new Federal Review Court with all the guardrails - term limits, enforced ethics requirements, etc - and assign it whatever powers of judicial review actually support rule of law.
That said, Congress passing an ethics bill with teeth, and perhaps amnesty for justices who resign immediately, might be enough to clear the bench of Leo's team.
